General terms and conditions
1 Scope
1.1 These general terms and conditions shall apply to all contracts between a consumer or an entrepreneur (hereinafter referred to as ‘customer’) with the operator of the website bhs-parts.de (hereinafter referred to as ‘supplier’) concerning the goods offered for sale.
1.2 For the purpose of these terms and conditions...
- a consumer means every natural person who enters into a legal transaction for purposes that predominantly are outside his trade, business or profession.
- an entrepreneur means a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.
2 Conclusion of contract
2.1 The placing of an order by the customer represents a legally binding offer of the customer to conclude a purchase contract with the supplier about the goods included in the order. The customer has the opportunity to correct the data entered by him before placing the order in the online shop.
By submitting this order, the customer declares his agreement with these terms and conditions.
2.2 A customer can place an order to the supplier, when...
- the customer clicks the button "Buy" to complete the order process in the online shop of the supplier.
- the customer explains his agreement with respect to an order to the supplier either by post, by telephone or by email.
2.3 The order of the customer is accepted by the supplier only by his declaration of acceptance,
- when the supplier sends an order confirmation in textual form by email to the customer
or
- by shipping the ordered goods to the customer
whereby finally a contract between the customer and supplier is accomplished.
The contract text is not stored by the supplier after conclusion of the contract and is not accessible to the customer.
2.4 The languages available for the contract are German and English.
3 Delivery
3.1 The goods will be shipped to the delivery address specified by the customer, unless otherwise agreed.
4 Claims for defects
4.1 The statutory liability for defects applies.
5 Payment
5.1 All prices of the supplier are quoted in euros plus shipping costs, but including the statutory sales tax, unless expressly stated otherwise.
6 Retention of title
6.1 The goods shall remain the property of the supplier until full payment.
7 Jurisdiction
7.1 If the customer is a merchant, a legal entity under public law or a special fund under public law, domiciled in the Federal Republic of Germany, the sole place of jurisdiction for all disputes arising from contractual relationships between the customer and the supplier shall be the place of business of the supplier.
8 Alternative Dispute Resolution
8.1 The EU Commission provides a platform for online dispute resolution (OS), available at: http://ec.europa.eu/consumers/odr/.
We are not obligated and unwilling to participate in a dispute settlement procedure before a consumer arbitration board.
